6.12.010 Definitions.
For the purposes of this chapter, "commercial stable," "riding stable" and "riding academy" mean and include any place where horses are kept, housed, boarded, lodged, fed, hired, trained, sold or bred as a commercial activity. (Prior code º 13-60)
6.12.020 Permit-Required.
No person shall establish, keep or maintain any commercial stable, riding stable or riding academy in the city without first having obtained a permit in writing from the city clerk to do so as provided under Section 6.08.151 of this code. (Ord. 5113 º 6, 1996: prior code º 13-61)
6.12.030 Permit-Application.
Any person desiring to obtain a commercial stable permit shall file a written application therefor with the city clerk, stating the proposed location of such commercial stable, the name of the applicant and the number of horses to be kept therein at any one time. Such application shall be accompanied by a filing fee, as established by Section 6.04.180. The applicant shall furnish the city clerk with the names and addresses of owners of the horses stabled therein. Only a single fee shall be required for an application to establish, keep or maintain such a commercial stable. (Prior code º 13-62)
6.12.040 Maximum number of horses.
No person shall keep in any stable more than the number of horses permitted by the stable permit. (Prior code º 13-63)
6.12.050 Use.
No person shall sleep, or prepare meals, or conduct similar personal living activities in horse stables or in attached accessory structures. (Prior code º 13-64)
6.12.060 Standing water prohibited.
All areas used in connection with the keeping of horses shall be so arranged as to prevent an accumulation of standing water. (Prior code º 13-65)
6.12.070 Dimensions.
A. Wherever horses are kept or maintained for commercial purposes, including rentals and boarding for a fee, there shall be a minimum lot area of five hundred square feet for each horse.
B. Exception. Wherever completely enclosed individual box stalls are provided with minimum dimensions eight feet in width and twelve feet in length an additional number of horses above the total allowed by this section may be allowed equal to the number of box stalls provided, but in no case shall the total number of horses exceed the ratio of one horse per four hundred square feet of lot area. 6.12.080 Public sanitary facilities.
A. Every commercial stable, or portion thereof, where the public is served shall be provided with a minimum of one toilet for each sex, in separated rooms, located so as to be reasonably convenient to the stable clientele.
B. The floors and walls of toilet rooms and all surfaces within two feet of the front and sides of urinals shall be finished with a smooth, hard, nonabsorbent material of portland cement, ceramic tile or
other approved materials. Walls shall be finished to a height of four feet above the floor. (Prior code º 13-67)
6.12.090 Fences and gates.
A. Wherever horses are kept or maintained for commercial purposes, including rentals and boarding for a fee, the perimeter of that portion of the property used for horses shall be completely enclosed with a fence and gates or other exits leaving a minimum height of six feet. The perimeter structure shall be capable of supporting a force of one hundred and fifty pounds per foot with the load applied three feet from the ground surface. The fence may be constructed of combustible materials in fire zone three. In the city and fire zone two the fence shall be constructed of:
1. Incombustible materials; or
2. Fire-retardant treated wood; or
3. One-hour fire-resistive construction.
B. Horizontal intermediate members in open-type railings shall be spaced not more than two and one-half feet apart.
C. Locks, latches and other gate-fastening hardware capable of holding gates in a closed position shall be used on all gates referred to in subsection B of this section. (Prior code º 13-68)
6.12.100 Exits.
Wherever horses are kept or maintained for commercial purposes, including rentals and boarding for a fee, each building or enclosure used in connection with the keeping of ten or more horses shall have at least two exits of a minimum width of eight feet. If two exits are required, they shall be placed a distance apart equal to not less than one-fifth of the perimeter of the area served. (Prior code º 13-69)
6.12.110 Fire-extinguishing systems.
A. 1. Standard automatic fire-extinguishing systems shall be installed as specified by Chapter 38 of the Uniform Building Code in all stables where horses are kept or maintained for commercial purposes, including rentals and boarding for a fee, when the area exceeds four hundred square feet and is not separated by at least one-hour fire-resistive walls of substantial construction. Attached haylofts, tack rooms and similar structures shall be considered part of the stables.
2. Exception. A minimum three-inch private fire line may be provided. The maximum area allowed to be served by such a system shall not exceed six thousand square feet.
B. When two or more areas are divided by one-hour fire-resistive walls of substantial construction, the number of sprinklers in the largest area plus one-half the number of sprinklers in the next largest single area may determine the cross main sizing. (Prior code º 13-70)
6.12.120 Horses kept in building.
All horses maintained on any lot or parcel in connection with a public stable, riding stable or riding academy shall be tethered or stabled within a building except when being ridden or when being exercised, groomed or trained by an attendant. (Prior code º 13-71)
6.12.130 Smoking prohibited-Signs posted.
Smoking shall be prohibited in any structure housing horses and in any area or structure used for the storage of feed and grain. There shall be posted at all points of ingress to any such structures or area, a sign stating "SMOKING PROHIBITED." Such sign shall be easily readable upon approaching any such structures or area. It shall be the responsibility of the stable or riding academy operator to cause compliance with this section. (Prior code º 13-72)
6.12.140 Nuisance conditions prohibited.
Any operation or use of any property as a commercial stable, riding stable, riding academy, private stable or public stable shall not make, cause, suffer or permit to be made or caused, any unnecessary noises, sounds or vibrations either of a continuing or of an intermittent nature, or produce, cause or emit any dust, fumes, odors or vapors which are annoying to persons of ordinary sensitivity or which are so harsh or so prolonged or unnatural or unusual in their intensity, time or place of occurrence as to occasion discomfort to the inhabitants of the city or any number thereof.
