FORTUNETELLING AND SIMILAR PRACTICES
5.56.010 Fortunetelling, etc.-Prohibited.

No person shall conduct, manage or carry on in the city the business or art of astrology, palmistry, phrenology, life reading, fortunetelling, cartomancy, crystal gazing, clairvoyance, clairaudience, magic, necromancy, psychism, mind reading, mental telepathy, automatic reading, spirit writing, slate writing, trance mediumship, sand gazing, materialization, ballot reading, conducting trumpet seances, or the making, giving or selling of charms, potions, talismans or magic things or articles. 5.56.020 Fortunetelling, etc.-Undertaking for remuneration to locate objects through psychic powers, clairvoyance, etc.
No person shall, for pay or remuneration of any kind whatsoever, by means of occult or psychic powers, faculties or forces, clairvoyance, clairaudience, spirit mediumship, seership, prophecy, astrology, palmistry, necromancy, materialization, ballot reading, trumpet seances, cards, talismans, charms, potions, magnetism or magnetized articles or substances, oriental mystics or magic of any kind or nature, undertake or pretend to find or restore lost or stolen money or property, or undertake or pretend to locate oil wells, gold or silver or other ore or metal or natural product. No person shall hire, or employ or ask, for himself or others, any person to do any of the things prohibited by this section. (Prior code º 11-17)
5.56.030 Fortunetelling, etc.-Applicability of Sections 5.56.010 and 5.56.020.
The provisions of Sections 5.56.010 and 5.56.020 shall not apply to any clergyman, minister, pastor or missionary accredited to or ordained by any bona fide church, ecclesiastical organization or religious corporation duly organized as such in conformity with the laws of the state while engaged in ministering to or conducting the religious worship or offices of such church, ecclesiastical organization or religious corporation; provided, that the fees, gratuities, emoluments or profits thereof shall be paid solely to or for the benefit of the church, ecclesiastical organization or religious corporation; provided further, that no specific charge shall be made, requested or required for the service of prophesying the future for a person not a member of the church or religious organization of the clergyman, minister, pastor or missionary performing such service; but nothing in this section shall be deemed to prohibit a voluntary contribution to such church or religious organization by any person receiving such service.
