5.52.010 Permit required.


No person shall distribute in the city any commercial advertising sample, handbill, dodger, circular, booklet or other notice of such advertising without first having obtained a permit in writing from the city to do so. All permits issued pursuant to this section shall expire on December 31st each year. (Prior code º 7-181)

5.52.020 Application-Appeal.


A. Any person desiring to obtain a permit to distribute in the city any commercial advertising sample, handbill, dodger, circular, booklet or other notice of such advertisement shall file an application in writing therefor with the city, giving the name, address and telephone number of the applicant, a general description of the commercial advertising samples, handbills, dodgers, circulars, booklets or other notices of such advertisement proposed to be distributed, and shall agree to distribute such material in accordance with the provisions of this chapter. Applicants shall pay an application and a revenue permit fee as set forth in the resolution pursuant to Section 5.08.010.

B. Any person aggrieved by the refusal of the city to issue a permit may appeal to the council within the time and in the manner provided in Chapter 2.88. (Prior code º 7-182)





5.52.030 Revocation.


The council may at any time revoke any permit issued under the provisions of this chapter for failure to comply with the demand, request or notice of the owner, occupant or person in charge of the premises that no such commercial advertising matter be distributed on such premises. 5.52.040 Manner of distribution.


Any person who has obtained a permit from the city manager to do so and has obtained the license required by Section 5.52.010 may distribute commercial advertising samples, handbills, dodgers, circulars or other notices of such advertisement in the city by placing the same on the porches of residences in a receptacle or device placed on such porch for that purpose, other than in mailboxes, if any such receptacle or device is there; or, if none is provided, then in such manner that such commercial advertising samples, handbills, dodgers, circulars or other notices will not blow from such porch onto lawns, yards, streets, alleys or public places in the city. 5.52.050 Distribution without owner's consent.


If the owner, occupant or person in charge of any residence, court, apartment, hotel or other premises shall forbid the distribution of commercial advertising samples, handbills, dodgers, circulars, booklets or other notices of such advertisement on the premises owned or occupied by him or her, or of which he or she is in charge, either by so advising the holder of any permit issued under the provisions of this chapter or any of the holder's agents or employees, or by posting and maintaining a sign on such premises reading "No Handbills," or words of similar import, it shall be unlawful for the holder of any such permit, the holder's agents or employees, to distribute commercial advertising samples, handbills, dodgers, circulars, booklets or other notices of such advertisement on such premises, and violation of the provisions of this section by the permittee, the permittee's agents or employees shall be grounds for the revocation of a permit issued under this chapter. 5.52.060 Certain acts prohibited.


A. No person shall distribute to or among pedestrians along or upon any public street, alley, park or other public place in the city or place in or on any automobile or other vehicle parked along or upon any public street, alley, park or other public place in the city, any commercial advertising sample, handbill, dodger, circular, booklet or other notice of such advertisement.

B. No person shall distribute or throw upon any street, alley or public place, or upon any private yard, lawn, driveway or sidewalk of any residence, or upon any vacant property, improved or unimproved, in the city, any commercial advertising sample, handbill, dodger, circular, booklet or other notice of such advertisement, nor shall any person throw upon any vacant improved property in other than an R zone any newspaper not subscribed for by the owner or person in control of the property; provided, that nothing in this section shall prohibit the placing of any regularly issued newspaper in the yards or on the porches of residences.

C. No person engaged in delivering papers in the city as a common carrier, or otherwise, nor any person receiving such papers for distribution, shall place or leave any newspapers or bundles of newspapers on any street corner, street, alley, lot or place in the city, unless such newspapers or bundles are folded, bound, tied or fastened so as to prevent the same from being scattered.
