30.80.010 Description and purpose.
The CEM zone is intended as a zone to address the unique requirements of cemetery uses in a manner conducive to the public health, safety and general welfare and in accordance with the comprehensive general plan of the city. (Prior code º 30-2200)
30.80.020 General provisions.
No person shall bury or inter, or cause to be buried or interred in the city, the body or remains of any human being except in the CEM cemetery zone. (Prior code º 30-2201)
30.80.030 Permitted primary uses and structures.
a. No building, structure or land shall be used and no building, structure or use in the CEM zone shall be erected, structurally altered, enlarged or established except the following permitted use and structure.
1. Cemeteries, including buildings and structures intended for the interment of human remains, churches, chapels, crematories, mortuaries, mausoleums, columbariums, sarcophagi and maintenance facilities. (Prior code º 30-2202)
30.80.040 Permitted accessory uses and structures.
The following accessory uses, buildings and structures shall be permitted in the CEM zone.
1. Administrative buildings.
2. Art stores and galleries.
3. Auditoriums.
4. Dwellings and sleeping quarters for persons employed on the premises.
5. Florist and plant shops.
6. Garden crypts.
7. Gates, fountains, statuary, decorative features and embellishments.
8. Gift shops.
9. Maintenance and storage.
10. Manufacturing of containers for caskets, remains and flowers.
11. Markers, headstones or monuments.
12. Museums.
13. Nurseries and garden supplies.
14. Parking in compliance with the provisions of chapter 30.124 of this title.
15. Repair and leasing of vehicles.
16. Signs, in compliance with the provisions of chapter 15.08 of this Code.
17. Other uses which the zoning administrator determines to be similar in nature, function, and operation to listed permitted accessory uses within this zone. (Prior code º 30-2203)
30.80.045 Conditional uses and structures.
The following uses and structures may be permitted in the CEM zone, subject to approval of a conditional use permit in compliance with the conditions and requirements of chapter 30.16, article VI of this title. The development standards of the zone shall apply except as otherwise provided herein.
a. Telecommunication facilities in compliance with the provisions of chapter 30.122. (Ord. 5176 º 20, 1997)
30.80.050 Site size.
The minimum site size in the CEM zone shall be twenty (20) acres. (Prior code º 30-2204)
30.80.060 Design review.
Design review shall be required in accordance with the provisions of chapter 30.16, article IX of this title. (Prior code º 30-2205)
30.80.070 Landscaping and screening.
Cemeteries shall be fenced or enclosed with walls or other appropriate fences a minimum of five and one-half (51/2) feet in height. When the property line of a cemetery is adjacent to residentially zoned property, it shall be of masonry or masonry facing. Cemetery boundaries not adjacent to a residentially zoned property may be fenced with appropriate landscaping and shrubbery to provide a sight-obscuring boundary. The principal entryways to cemeteries shall be clearly defined by architecturally treated entry gates and gate structures. Any space between a public street and a solid wall or fence shall be landscaped and permanently maintained. Such area shall not be used for interment. (Prior code º 30-2206)
