30.122.010 Purpose.
The purpose of the regulations in this chapter is to protect the public health, safety, general welfare and to provide wireless telecommunication service to the community in a safe, effective and efficient manner. (Ord. 5176 º 39 (part), 1997)
30.122.020 Aesthetics.
The following standards shall apply unless found by the director of planning or the design review board that physical or technical considerations would preclude adherence to said standards. The antennas and supporting structure and equipment shall be a color which in the opinion of the director of planning or the design review board, blends the antennas to the natural setting and built environment and helps camouflage the facility. All ground-mounted equipment shall be completely screened and/or camouflaged from public view. All equipment and appurtenances necessary for the operation of any wireless telecommunication services are encouraged to be located within a preexisting structure or below grade. When a new structure is required to house such equipment, such structure shall be harmonious with and blend with the natural features, and be compatible with buildings and structures surrounding such structure. 30.122.030 Design review requirements.
All wireless telecommunication facilities shall comply with the requirements as specific within article X, chapter 30.16 of this title. (Ord. 5176 º 39 (part), 1997)
30.122.040 Conditional use permit requirements.
Conditional use permit requirements shall be as specified within each respective zoning district. (Ord. 5176 º 39 (part), 1997)
30.122.050 Height.
Height requirements shall be as specified within each respective zoning district. (Ord. 5176 º 39 (part), 1997)
30.122.060 Lighting.
Antenna lighting shall be prohibited in all zones except where required by the Federal Aviation Administration. (Ord. 5176 º 39 (part), 1997)
30.122.070 Security of wireless telecommunication facilities.
Every wireless telecommunication facility and antenna support structure shall be protected against unauthorized climbing or other access by the public. Barbed wire fencing or razor wire fencing shall be prohibited. (Ord. 5176 º 39 (part), 1997)
30.122.080 Co-location of facilities.
Wireless telecommunication facilities are encouraged to be located on preexisting antenna support structures or other preexisting buildings or structures. (Ord. 5176 º 39 (part), 1997)
30.122.090 Removal provisions.
In the event one or more antennas, an antenna support structure, or related equipment are not operated for the provision of wireless telecommunication services for a continuous period of twelve (12) months or more, such antennas, antenna support structure, and related equipment may be deemed to be abandoned. The owner of same shall remove such items within ninety (90) days following the mailing of a written notice that removal is required. If two (2) or more providers of wireless telecommunication services use the antenna support structure or related equipment, the period of non-use under this section shall be measured from the cessation of operation at the location by all such providers. Failure to remove shall constitute a public nuisance. (Ord. 5176 º 39 (part), 1997)
30.122.100 Annual performance certification.
Wireless telecommunications providers shall submit a certification to the director of planning, upon application and annually thereafter, at said operator's cost, by a qualified independent contractor approved by the director of planning, which provides that said provider's radio frequency emission levels meet Federal Communications Commission (FCC) requirements. All wireless telecommunication facilities which fail to meet FCC radio frequency emission levels shall be remedied within thirty (30) days of receiving notice of said failure from the City. 30.122.110 Non-interference with television and radio operations.
Wireless telecommunications providers shall ensure that their wireless telecommunications facilities do not cause interference with reception of area television or radio operations and shall ensure continuous compliance with federal and state requirements regarding interference with reception of such operations. 30.122.120 Notification of change of ownership/operator.
Upon assignment or transfer of a conditional use permit or any of the rights thereunder to a new wireless telecommunication operator, the owner or operator shall provide written notice within thirty (30) days to the director of planning and the permit services administrator.
