30.12.010 Zoning regulations, general.
All new construction, building improvements, alterations or enlargements undertaken after April 23, 1986, and all new uses or occupancy of premises within the city shall conform with the requirements, character, and conditions as to use, height, and area for each of the several zones as described in the following sections of this title. No person shall design, erect, construct, establish, move into, alter, enlarge, or use, or cause, or permit to be erected, constructed, established, moved into, altered, enlarged or used any building, structure, improvement, or use of premises located in any zone described in this part contrary to the provisions herein. 30.12.020 Compliance.
Any condition which does not conform to the provisions of this title is a misdemeanor and a violation thereof is a public nuisance subject to abatement by the city. No such license for uses, building or purposes where the same would be in conflict with the provisions of this title shall be issued. Any such license or permit, if issued in conflict with the provisions of this title, shall be null and void. (Prior code º 30-301)
30.12.030 Interpretation.
When interpreting and applying the provisions in this part, they shall be held to be the minimum requirement for the promotion of the public health, safety, comfort, convenience and general welfare. Where any portion of this title imposes a greater restriction or regulation upon buildings, structures and/or uses than are imposed or required by other ordinances, rules, regulations or by easements, covenants or agreements, the most restrictive provisions of this title shall apply. 30.12.040 Severability.
If any section, subsection, sentence, clause, phrase or portion of this Code is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Code. The city council hereby declares that it would have adopted this Code and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, phrases or portions be declared invalid or unconstitutional. 30.12.100 South Brand Boulevard specific plan.
On properties contained within the South Brand Boulevard specific plan area which are generally bounded by Colorado Street on the north, Central Avenue on the west, San Fernando Road on the south and Glendale Avenue/Louise Street on the east as specified in the plan document shall be governed by the development standards contained therein. Said development plans are by this reference incorporated therein as if fully set forth and shall be on file in the office of the director of planning. The specific plan and more particularly the development standards may be amended from time to time as provided under the California Government Code, the City of Glendale Charter and this Code. This title shall also be applicable for those properties unless otherwise specified within the specific plan. Whenever conflicts between the application of the specific plan and this title arise, those provisions which are the more restrictive to the issue shall apply. All other provisions of this title shall apply in the specific plan area including but not limited to definitions, changes of zone and amendments, variances, home occupation permits, appeals and design review. 30.12.110 Zoning map.
The boundaries of the zones and the applicable height districts are hereby established as set forth on maps entitled "1986 Zoning and Height District Map, Glendale, California" on file in the office of the planning division, which map is hereby adopted and made a part of this Code together with such other maps and changes as may hereafter be adopted as part of this title. 30.12.120 Zone boundaries-Interpretation.
Except where referenced on the zoning map to a street line or other designated line by dimensions shown on such map, the zone boundary lines are intended to follow lot lines or the center line of streets or alleys or transportation right-of-way lines as they existed at the time of the establishment of the map or any amendments of same.
Where a street or lot layout actually on the ground or as recorded differs from the street and lot lines as shown on the zoning map, the director of planning, on application, shall interpret the map in such a way as to carry out the intent and purpose of this zoning ordinance. (Prior code º 30-310)
30.12.130 Zone of annexed territory.
All territory hereafter annexed to the city of Glendale shall upon annexation be zoned in accordance with a prezoning plan adopted in the manner required by law for change of zone. Said prezoning plan shall be prepared and adopted as a part of the official annexation proceedings, and shall take into account all applicable city plans, policies and documents. 30.12.140 Design standards for lots and parcels of land.
The standards of chapter 16.20 of this Code shall be applicable to the design of lots and parcels of land when applying the provisions of this title and when considering any application for a procedure prescribed by this Code. (Ord. 5009 º 52, 1993: prior code º 30-312)
30.12.150 Denial of building permit until parcel map is approved.
Except as otherwise provided in this Code, no building permit shall be issued and no building or structure shall be constructed or altered on any land which has been separated in ownership in violation of the provisions of this Code until and unless a parcel map has been recorded.
