30.08.010 Definitions.


For the purpose of this title, the following terms, phrases, words and their derivations shall have the meaning given herein. (Prior code º 30-200)

30.08.020 Accessory building or structure.


"Accessory building or structure" means a detached subordinate building or structure the use of which is customarily incidental to that of the main building(s) or use(s) located on the same lot. (Prior code º 30-201)

30.08.030 Accessory living quarters and/or guest house.


"Accessory living quarters and/or guest house" means living quarters within an accessory building for the sole use of persons employed on the premises or members of the family living in the main building; such quarters having no kitchen facilities and not rented or otherwise used as a separate dwelling. (Prior code º 30-202)

30.08.040 Alley.


"Alley" means an unnamed public or private right-of-way less than twenty-two (22) feet wide that is primarily designed to serve as secondary access to the rear or side of those properties whose principal frontage is on some other street. (Prior code º 30-203)

30.08.050 Alteration or altered.


"Alteration or altered" means any change or modification in the construction of a building or structure other than for repairs. (Prior code º 30-204)

30.08.055 Antenna.


"Antenna" means any system of wires, poles, rods, reflecting discs, panels, microwave dishes, whip antennas or similar devices used for the transmission or reception of electromagnetic waves, including antennas relating to Personal Wireless Services as defined by the federal Telecommunications Act of 1996, when such system is either external to or attached to the exterior of a structure (building-mounted or rooftop-mounted), or ground-mounted. Antennas shall include devices having active elements extending in any direction, and directional beam-type arrays mounted upon and rotated through a vertical mast or tower interconnecting the beam and antenna support, all of which elements are deemed to be a part of the antenna. 30.08.060 Arcade establishment.


"Arcade establishment" means any place of business containing five (5) or more arcade devices or a combination of arcade devices and billiard tables as defined in section 5.20.020 of this Code totalling five (5) or more, excepting therefrom any billiard establishment containing less than five (5) arcade devices. 30.08.070 Attached.


"Attached" means any building or structure that has a wall or roof in common with another building or structure. (Prior code º 30-206)

30.08.080 Boardinghouse or lodging house.


"Boardinghouse or lodging house" means a dwelling with not more than five (5) guest rooms, with or without lodging and meals for compensation, not including those facilities defined as retirement or rest homes. (Prior code º 30-207)

30.08.090 Building.


"Building" means anything constructed having a roof supported by columns or walls for the purpose of housing, shelter or enclosure. (Prior code º 30-208)

30.08.100 Building envelope.

"Building envelope" means the volume in which buildings may be constructed on a lot. This volume is a combination of height, setback, and locational standards shown on diagrams elsewhere in this title and on final tract maps. (Ord. 5009 º 50, 1993: prior code º 30-208.1)

30.08.110 Car wash.


"Car wash" means an establishment providing facilities for the washing of motor vehicles and open to the public. (Prior code º 30-209)

30.08.120 Car wash, self-service.


"Car wash, self-service" means a car wash wherein the customer provides labor and where no self-propelled wash racks are provided. (Prior code º 30-210)

30.08.130 Centerline (of street).


"Centerline (of street)" means the center of the right-of-way as established by the city engineer. (Prior code º 30-211)

30.08.140 Commercial vehicle.


"Commercial vehicle" means an automobile, truck, bus or van which is used in connection with a business and contains exterior advertising and/or visible equipment. (Prior code º 30-212)

30.08.150 Convalescent homes or sanitariums.


"Convalescent homes or sanitariums" mean places or institutions which make provisions for medical treatment and bed care, or for chronic care of persons who by reason of age, illness or physical infirmity are unable to properly care for themselves. No services are provided to nonresidents. (Prior code º 30-213)

30.08.160 Corral.


"Corral" means a pen or enclosure for confining animals. (Prior code º 30-214)

30.08.170 Coverage.


"Coverage" means the ground area occupied by any building or structure not completely open to the sky. Areas occupied by cornices and roof eaves, projecting not over thirty (30) inches, landscaped roof decks of subterranean and semi-subterranean garages readily accessible to tenants and private vehicular drives shall not be computed in determining coverage. Diagram D-1, which follows and is made a part of this chapter, shall be illustrative of the meaning of "coverage." (Prior code º 30-215)

30.08.180 Cribwall.


"Cribwall" means a system of interlocking concrete forms containing exposed earth openings to allow for plant growth which acts as a retaining wall to support earth materials. (Ord. 5009 º 47, 1993: prior code º 30-215.1)

30.08.190 Curb level.


"Curb level" means the top of curb elevation abutting the property. Where no such curb level exists and a curb level is planned, the curb level shall be determined from plans for the ultimate designed roadway improvements approved by the city engineer. Where no curb level is existing or planned, the curb level shall be construed to mean the elevation at the centerline of the street right-of-way abutting the property. (Prior code º 30-216)

30.08.200 Day care center.


"Day care center" means a facility operated by a person, corporation, or association in which less than twenty-four (24) hour per day nonmedical care and supervision is provided outside the home for minor children or elderly persons, provided such facility is licensed by the state of California as a day care center, and provided further that a copy or evidence of the license issued by the state of California is on file with the city clerk prior to occupancy as such a facility. 30.08.210 Delicatessen.


"Delicatessen" means an establishment which serves prepared food, of which there is no on-site consumption, and there is either no on-site consumption or on-site consumption of food is limited to an area containing a maximum of eight (8) seats. (Ord. 5042 º 1, 1994: prior code º 30-218)

30.08.220 Detached.


"Detached" means any building or structure separated by at least five (5) feet in horizontal distance from any other building or structure. (Prior code º 30-219)

30.08.230 Dish antenna.


"Dish antenna" means any device incorporating a reflective surface that is solid, open mesh, or bar configurated and is in the shape of a shallow dish, cone, horn, cornucopia or flat plate, and has a diameter in excess of three (3) feet; which device is used to receive or transmit radio or electromagnetic waves between terrestrially and/or orbitally based units. This definition shall include, but not be limited to, what is commonly referred to as satellite earth stations, satellite receivers, satellite discs, direct broadcast systems (DBS's), television reception only systems (TVRO's) and satellite microwave antennas. 30.08.240 Down slope wall.


"Down slope wall" means the walled side(s) of any building or structure facing down hill. (Prior code º 30-221)

30.08.250 Dwelling.


"Dwelling" means a building or any portion thereof designed exclusively for residential purposes, including single and multiple residential dwellings but not including hotels, motels and other places without individual kitchen facilities. (Prior code º 30-222)

30.08.260 Dwelling unit.


"Dwelling unit" means a single unit providing complete, independent living facilities for one (1) person or household, including permanent provisions for living, sleeping, eating, cooking and sanitation. (Prior code º 30-223)

30.08.270 Dwelling, multiple residential.


"Dwelling, multiple residential" means a building or portion thereof designed for occupancy by two (2) or more persons or households living independently of each other. (Prior code º 30-224)

30.08.280 Dwelling, one residential.


"Dwelling, one residential" means a detached building designed exclusively for occupancy by one (1) household. (Prior code º 30-225)

30.08.290 Efficiency unit.


"Efficiency unit" means a dwelling unit of not more than one (1) room in addition to a kitchen and bathroom and containing no separately walled-in bedroom area. (Prior code º 30-226)

30.08.300 Enlarged.


"Enlarged" means an increase in floor area or height of a building or structure. (Prior code º 30-227)

30.08.310 Floor area (gross).


"Floor area (gross)" means the sum of the gross horizontal areas of the several floors of the building measured from the exterior faces of the exterior walls excluding exterior balconies and porches. Floor area shall not include interior parking spaces, loading spaces for motor vehicles, any space where the floor to ceiling height is less than six (6) feet, and attics and mechanical penthouses provided there are no useable rooms, no windows and the mechanical penthouse area is used exclusively for mechanical equipment. Floor area shall include any work area in auto repair, or related facilities, where vehicles are serviced and repaired. Diagram D-2, which follows and is made a part of this chapter, shall be illustrative of the meaning of "floor area (gross)." (Prior code º 30-228)

30.08.320 Floor area ratio.


"Floor area ratio" means the ratio of floor area plus garage area to lot area. Indoor recreational facilities, subterranean and semi-subterranean garage areas shall be excluded from this ratio. (Prior code º 30-228.1)

30.08.330 Frontage.


"Frontage" means that portion of a lot which abuts a public street. Diagram D-3, which follows and is made a part of this chapter, shall be illustrative of the meaning of "frontage." (Prior code º 30-229)

30.08.340 Garage.


"Garage" means an accessory building, or portion of a building, for the parking or storage of motor vehicles. (Prior code º 30-230)

30.08.350 Garage, private.


"Garage, private" means a detached accessory building or portion of a main building for the parking or temporary storage of motor vehicles of the occupants of the premises and, in private residential garages, other accessory residential uses to the extent that space is provided in excess of that required by chapter 30.124 of this title for the parking of vehicles. 30.08.360 General plan.


"General plan" means a statement of development policies including diagrams and text setting forth objectives, principles, standards and plan proposals. (Prior code º 30-232)

30.08.370 Grade.


"Grade" means the average of the highest and lowest top of curb elevations of the existing curb in front of the property. In the case of a through lot, at the developer's option, grade shall be determined as above but may control only the nearest fifty (50) percent of the site abutting each street. (Prior code º 30-233)

30.08.380 Height.


"Height" means the vertical dimension from the lowest point of the building, structure or wall exposed above the ground surface to the highest point of the roof, parapet wall or uppermost part, except as may be shown otherwise on diagrams in this title related to specific height/building envelope standards for specific zones. Chimneys, vents, utility service structures, or portions of a building located below the ground surface existing at the time of construction and exposed as a result of excavation to create door, window or ventilation openings shall not be included in the measurement of vertical dimensions, however, any ground-mounted dish antenna attached to a building or structure or any roof-mounted dish antenna shall be considered in the calculation of height. 30.08.390 Horse.


"Horse" means any quadruped of the genus equus. (Prior code º 30-235)

30.08.400 Hotel or motel.


"Hotel or motel" means a building in which there are six (6) or more guest rooms where lodging with or without meals is provided for compensation, and where no provision is made for cooking in any individual room or suite. (Prior code º 30-236)

30.08.410 Household.


"Household" includes all the persons who occupy a residential dwelling. (Prior code º 30-237)

30.08.420 Indoor recreational facility.


"Indoor recreational facility" means a fully enclosed room or rooms located completely within a multiresidential building for the private recreational use of the occupants of the premises. Such facilities may include, but shall not be limited to, spas, saunas, swimming pools, weight/gymnastics rooms, billiard or similar table-top game rooms, or other uses which the zoning administrator determines to be similar in nature, function and operation to those listed above. 30.08.425 Industrial mixed-use/large scale project.


"Industrial mixed-use/large scale project" means a development project containing a minimum of five (5) contiguous acres, located within a redevelopment project area, controlled by a single land owner and developed as a unified project in conformance with a Project Master Plan under an executed Disposition and Development Agreement (DDA) and/or an Owner Participation Agreement (OPA). 30.08.430 Landscaping.


"Landscaping" means the planting and maintenance of live trees, shrubs, vines, ground covers, flowers or lawns. Ornamental features such as rocks, fountains, ponds and other accessory materials may be utilized to accent or compliment the vegetation. (Prior code º 30-238)

30.08.440 Loading space.


"Loading space" means an off-street area solely for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials. (Prior code º 30-239)







30.08.450 Lot.


"Lot" means a parcel of land shown with a separate and distinct number on an official map in the office of the recorder of Los Angeles County, or a parcel of land shown as separate and distinct from contiguous property upon a map approved by the council, the board of zoning adjustments or the zoning administrator in the manner provided by ordinance, or a parcel of property abutting upon at least one (1) public street and held under separate ownership prior to September 1, 1956, or having legally recorded easement rights. Where two (2) or more contiguous lots in the same ownership are proposed to be developed or are developed as one (1) building site, then the usual accessories may be located on any of said lots and thereafter all of said lots shall be deemed and construed to be single lot. Diagram D-5, which follows and is made a part of this chapter, shall be illustrative of the meaning of "lot." (Prior code º 30-240)

30.08.460 Lot area.


"Lot area" means the total horizontal area within the boundary lines of a lot. Diagram D-5, which follows and is made a part of this chapter, shall be illustrative of the meaning of "lot area." (Prior code º 30-241)

30.08.470 Lot, corner.


"Lot, corner" means a lot situated on the intersection of two (2) or more streets having an angle of intersection of not more than one hundred thirty-five (135) degrees. Diagram D-5, which follows and is made a part of this chapter, shall be illustrative of the meaning of "lot, corner." (Prior code º 30-242)

30.08.480 Lot, interior.


"Lot, interior" means a lot other than a corner lot. Diagram D-5, which follows and is made a part of this chapter, shall be illustrative of the meaning of "lot, interior." (Prior code º 30-243)

30.08.490 Lot width.


"Lot width" means the dimension at the front property line, except in the ROS and R1R zones where the lot width shall be calculated at a line located fifteen (15) feet from the front property line and parallel to the front property line. Diagram D-6, which follows and is made a part of this chapter, shall be illustrative of the meaning of "lot width." (Prior code º 30-244)

30.08.500 Masonry.


"Masonry" means and includes construction materials of concrete, block, brick, rock, tile and/or stucco. (Prior code º 30-245)

30.08.510 Nonconforming.


"Nonconforming" means a building, structure or portion thereof, or use of a building or land which lawfully existed and was not unlawfully used on the effective date of the zoning restriction and the existence and use continued since such time in nonconformance to the ordinance. 30.08.520 Open space, useable.


"Open space, useable" means an open area which is accessible having an average overall finish grade not exceeding ten (10) percent and a maximum grade of fifteen (15) percent and a minimum width of not less than ten (10) feet. No portion of a building including balconies, atriums and cantilevered decks shall be computed in the determination of average overall finish grade. Nothing in this section shall prohibit useable open space areas from containing topographic features exceeding the maximum design grade criteria if those features are designed solely for architectural or landscape relief, provided that those areas are approved by the director of planning. Useable open space areas may include private courtyards, porches, and terraces, but shall not include balconies, cantilevered structures, land occupied by buildings, structures, streets, driveways, median strips or parking areas. The useable open space may, however, contain such recreational facilities, complementary structures and improvements as are necessary and appropriate for the common benefit and enjoyment of residents of the project, including clubhouses, swimming pools, tennis courts, golf courses, play areas, walks and riding trails, and facilities found to be similar in character to the uses enumerated in this section. 30.08.530 Pad.


"Pad" means the area of a lot which does not exceed a slope of fifteen (15) percent except for the slope between the levels of a split level pad, which may exceed fifteen (15) percent and exclusive of that certain property between the front property line and a line fifteen (15) feet back from and parallel to the front property line, and four (4) feet back from any property line that intersects the front property line. Diagram D-7, which follows and is made a part of this chapter, shall be illustrative of the meaning of "pad." (Prior code º 30-248)

30.08.540 Parking area.


"Parking area" means an area, other than a street, alley or right-of-way, used for the parking or storage of one (1) or more vehicles. (Prior code º 30-249)

30.08.550 Parking space.


"Parking space" means an area accessible and available for the parking of one motor vehicle, other than a vehicle for sale, lease or rent, exclusive of areas intended for other uses and of physical obstructions as specifically allowed by this title. (Prior code º 30-250)

30.08.560 Place of assembly.


"Place of assembly" means an area designed for the meeting or congregation of large numbers of people. (Prior code º 30-251)

30.08.570 Planned residential development.


"Planned residential development" means an area of land, controlled by a landowner, to be developed as a unified project and single entity for a group of townhouse dwellings and/or detached dwelling units, the plan for which may not correspond in lot size, bulk or type of dwelling, density, lot coverage, setback or required open space to the regulations in any one residential district established in this title. 30.08.580 Professional offices.


"Professional offices" means offices providing professional services by accountants, attorneys, design professionals, engineers, physicians and other health professionals, and public relations persons. (Prior code º 30-253)

30.08.590 Property line, front.


"Property line, front" means, in the case of an interior lot, a line separating the lot from the street. In the case of an interior lot with more than one street frontage, each such frontage shall be a front property line. In the case of a corner lot, a line separating the narrowest street frontage of the lot from the street shall be a front property line. In the case of a "lot" created as a result of a combination of two (2) or more contiguous lots, or by a proposed or recorded subdivision or parcel map, the front property line shall be established on the basis of the predominant orientation of lots existing in the immediate vicinity of said property to the satisfaction of the director of planning. 30.08.600 Property line, interior.


"Property line, interior" means any property boundary line which is not alongside a street. Diagram D-8, which follows and is made a part of this chapter, shall be illustrative of the meaning of "property line, interior." (Prior code º 30-255)

30.08.610 Property line, street side.


"Property line, street side" means any property line abutting a street other than a front property line. Diagram D-8, which follows and is made a part of this chapter, shall be illustrative of the meaning of "property line, street side." (Prior code º 30-256)

30.08.620 Public dance.


"Public dance" means and includes any dance:

a. To which admission may be had by the payment of a fee or cover charge, or equivalent, or by the purchase, possession, or presentation of a ticket or token;

b. To which admission may be gained by a person without invitation or by anyone who cannot be identified at the time of the issuance of the invitation by the sender;

c. Any gathering of persons upon any premises except a private home where no direct or indirect charge for admission is made, where dancing is participated in either as the main purpose of such gathering or as an incident to some other purpose for which the public is admitted;

d. At which or during the course of which instruction in the art of dancing is given or offered for those in attendance; or

e. To which the public generally may gain admission with or without the payment of a fee. (Prior code º 30-257)

30.08.630 Repair.


"Repair" means the reconstruction or renewal of any part of an existing building for the purpose of its maintenance. (Prior code º 30-258)

30.08.640 Restaurant, fast food.


"Restaurant, fast food" means an establishment which is engaged primarily in the business of preparing food and purveying it on a self serve or semi-self serve basis. Customer orders and/or service may be by means of a walk-up counter or window designed to accommodate automobile traffic. Consumption may be either on or off the premises. (Prior code º 30-259)

30.08.650 Restaurant, full service.


"Restaurant, full service" means an establishment which is engaged primarily in the business of preparing and serving meals for consumption on the premises. Such restaurants employ help to fully accommodate customer orders at the table. (Prior code º 30-260)

30.08.660 Retirement or rest home.


"Retirement or rest home" means a residence where ambulatory persons, or ill persons are provided limited dietary, and other limited personal services, but excluding cases of contagious or communicable diseases and excluding surgery or primary treatments as are customary in sanitariums and hospitals. No services are provided to nonresidents. (Prior code º 30-261)

30.08.670 Roof.


"Roof" means a part of a building completely covering any portion of such building and permanently attached but excluding chimneys, antennas, vents and mechanical equipment. (Prior code º 30-262)

30.08.680 Room.


"Room" means an unsubdivided portion of the interior of a dwelling, excluding bathrooms, closets, hallways and service porches. (Prior code º 30-263)

30.08.690 School, private.


"School, private" means an educational institution other than a public school which offers instruction in the several branches of learning and study required to be taught in the public schools or where instruction is given in the vocational, professional or recreational fields. (Prior code º 30-264)

30.08.700 School, public.


"School, public" means an institution of learning operated by a public body which offers instruction in the several branches of learning and study required to be taught in the public schools by the Education Code of the state of California. (Prior code º 30-265)

30.08.710 Semi-subterranean.


"Semi-subterranean" means that portion of a building having a finished floor level or roof level directly above it which does not exceed four and one-half (41/2) feet above grade. Diagram D-9, which follows and is made a part of this chapter, shall be illustrative of the meaning of "semi-subterranean." (Prior code º 30-266)

30.08.720 Service station, automobile.


"Service station, automobile" means a place of business where motor vehicle fuel is sold to the general public. Other activities permitted may include the sales of related goods and services for motorists, or performance of maintenance and minor repairs to vehicle excluding body work, painting or washing of vehicles. 30.08.730 Setback.


"Setback" means the minimum distance required between a property line and building or structure measured perpendicular from the property line. The setback for swimming pools and spas shall be measured from the edge of the water line for below surface pools and from the nearest point of the structure for above surface pools. Diagram D-10, which follows and is made a part of this chapter, shall be illustrative of the meaning of "setback." (Prior code º 30-268)

30.08.740 Setback, interior.


"Setback, interior" means the minimum distance required between a building or structure and any property line which does not abut a street. (Prior code º 30-269)

30.08.750 Setback, street front.


"Setback, street front" means the minimum distance required between a building or structure and the front property line. (Prior code º 30-270)

30.08.760 Setback, street side.


"Setback, street side" means the minimum distance required between a building or structure and any property line which abuts a street other than the front property line. (Prior code º 30-271)

30.08.770 Slope, average current.


"Slope, average current" means the gradient in percent of the current land before any current grading or other terrain modification is commenced. The average slope of a parcel of land or any portion thereof shall be computed by applying the formula

to the current slope of the land, as determined upon accurate topographic surveys using a contour interval no greater than ten (10) feet, and a horizontal map scale of one inch equals one hundred feet (1? = 100?) or larger. Such maps and calculations shall be certified by a registered civil engineer or licensed land surveyor as to their accuracy. The letters in this formula shall have the following significance:



S = Average percent current slope

I = Contour interval, in feet

L = Summation of length of contour lines within the boundary of the project, in feet

A = Gross area of the project, in acres. (Prior code º 30-272)

30.08.780 Stable, private.


"Stable, private" means a detached accessory building for the keeping of horses owned by the occupants of the premises and not kept for remuneration, hire or sale. (Prior code º 30-273)

30.08.790 Story.


"Story" means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above, except that the topmost story shall be that portion of a building included between the upper surface of the topmost floor and the ceiling or roof above. A basement, cellar, parking garage or unused underfloor space shall not be considered a story if three (3) feet or less above grade. Diagram D-11, which follows and is made a part of this chapter, shall be illustrative of the meaning of "story." (Prior code º 30-274)

30.08.800 Street, future.


"Street, future" means an area designated on a map as a "future street" which is proposed to be used as a new or enlarged public right-of-way at some time in the future as may be necessary to provide access to certain property or as may be necessary to provide for adequate street widths. (Ord. 5009 º 51, 1993: prior code º 30-274.1)

30.08.810 Street, private.


"Street, private" means a thoroughfare approved by the city council as an undedicated private street and posted as a private street. (Prior code º 30-275)

30.08.820 Street, public.


"Street, public" means any public thoroughfare other than an alley, walk, or limited access highway; the side lines of the right-of-way constitute the side lines of a street. (Prior code º 30-276)

30.08.830 Structure.


"Structure" means anything constructed, for which a permit is required and has a foundation but no roof. "Structure" does not include fences and walls. (Prior code º 30-277)

30.08.840 Subterranean.


"Subterranean" means a building which is completely below grade or that portion of the enclosed floor area of a building having a top of slab level or roof level directly above it which does not exceed grade along the entire perimeter of such floor space level. (Prior code º 30-278)

30.08.850 Tire store.


"Tire store" means a place where the principal business is the sale or installation of new, used or retread tires and tubes. (Prior code º 30-279)

30.08.860 Underlying zone.


"Underlying zone" means any zone other than an overlay zone which is applicable to a property. (Prior code º 30-280)

30.08.870 Vehicle storage or vehicle sales display area.


"Vehicle storage or vehicle sales display area" means an area used for the storage of new or used vehicles of any type, or an area used for the storage of vehicles undergoing repair. (Prior code º 30-281)

30.08.880 Warehousing.


"Warehousing" means the use of a building or structure as storage space for goods of any type, excepting incidental storage and goods stored solely for use on the premises. (Prior code º 30-282)

30.08.890 Wholesaling.


"Wholesaling" means sales to retailers or merchants for the purpose of their own business use or resale only, and not to consumers or the public in general. (Prior code º 30-283)

30.08.900 Wireless telecommunication facility.


"Wireless telecommunication facility" means a facility that transmits and/or receives electromagnetic signals for the purpose of transmitting analog or digital voice or data communications. It includes antennas, microwave dishes, horns and other types of equipment for the transmission or receipt of such signals, telecommunication towers or monopoles, or similar structures supporting said equipment, equipment buildings, shelters or cabinets, and other accessory development. "Wireless telecommunication facility" includes Personal Wireless Services as defined in the federal Telecommunications Act of 1996, and as subsequently amended. "Wireless telecommunication facility" shall not include the following: federally-licensed amateur radio stations and facilities used exclusively for receive-only antennas.
