2.40.010 Established-Composition.
An environmental and planning board is established, and it shall consist of the director of public works, director of planning and city attorney. The board may elect a chairperson from amongst themselves and the director of planning shall serve as secretary thereto. The secretary shall be responsible for giving all necessary notices and shall keep minutes of the meetings. Two members shall constitute a quorum, but a lesser number may adjourn to a time certain or until the next regular meeting. (Prior code º 2-47)
2.40.020 Meetings-Functions and duties.
A. The board shall meet weekly at a time and place set by it, or on call whenever necessary to consider and report on private applications or proposals of various public agencies or city divisions which may have a significant effect upon the environment and which require its consideration for the preparation, review, recommendation or other appropriate action on environmental impact reports when required by the Environmental Quality Act of 1970 (Public Resources Code, Section 21000, et seq.). The city manager or any two board members in the city manager's absence may call a special meeting.
B. The functions of the board are generally to fulfill the duties of the "appropriate local planning agency" as mentioned and contained in Section 21151 of the Environmental Quality Act or as specified in Section 65402 of the Government Code or other state law which may be construed by court decision to be incorporated in such Act, and this section shall expressly supersede and control any other section in this code that is or may be deemed to be inconsistent with this chapter.
C. The board shall perform such other duties as the council may from time to time impose upon it by resolution. (Prior code º 2-48)
2.40.030 Reconsideration.
The board may reconsider any decision made by it, upon the written request of any interested person or entity or by the initiation of any board member. Written notice of the request to reconsider shall be given by mail to any person as may have appeared and addressed the board at the prior meeting or that has requested such notice in writing. Such notice shall be mailed by the board at least seven days prior to the meeting set for such reconsideration. The board may revise, affirm or modify its decision and may make such further decision or determination as may appear just and reasonable. A request for reconsideration of the decision to either prepare an environmental impact report or negative declaration shall be filed within seven days of the determination of the board. 2.40.040 Appeal.
Any person, including any city official aggrieved by the reconsideration decision of the environmental and planning board may appeal to the council within the time and in the manner provided in Chapter 2.88. (Prior code º 2-48.2)
