10.36.010 Limited parking areas-Established.
The transportation and parking commission is empowered to, and shall, by resolution, determine those streets or parts of streets upon which parking shall be limited in duration, times of day or days, and the traffic and transportation administrator shall designate such streets or parts of streets by appropriate signs, curb markings or other such markings. 10.36.015 Parking lot limits-Establishment-Signs or markings.
The council shall, by resolution, determine parking lot restrictions and limitations and the traffic and transportation administrator shall designate such limits by appropriate signs, curb markings or other such markings. (Ord. 5078 º 1, 1995: prior code º 27-106.1)
10.36.020 Limited parking areas-Violations.
A. When authorized signs or curb markings are in place on any street, part of a street, or a municipal parking lot, giving notice of parking limitations, no person shall stop, stand or park any vehicle in any such street, part of a street, or municipal parking lot, for a period of time longer than indicated by such signs or curb markings.
B. On any calendar day, successive acts of parking within a distance of three hundred feet on any street, part of a street, or municipal parking lot, shall be deemed a single act of parking within the meaning of this section, subject to the longest parking limitation applicable to the portion of such street, part of a street, or municipal parking lot, lying between the parking places so used. 10.36.030 Preferential parking district program established.
A. Definitions. For purposes of this section, unless otherwise apparent from the context, certain words, terms and phrases used in this section are defined as follows:
"Adjacent dwelling unit" means a residential dwelling unit fronting upon or having direct access to a residential street by means of a front door, entry way or driveway or any combination thereof.
"Resident" means a person who lives in an adjacent dwelling unit located in a preferential parking district established or under consideration for establishment.
"Preferential parking district" means a district of certain streets or portions thereof, which are designated by the transportation and parking commission as a preferential parking district in which certain vehicles displaying valid preferential parking permits shall be exempt from posted parking restrictions, or in which vehicles may not park unless an authorized permit or other indicia is displayed thereon: or unless such vehicle is otherwise exempt as provided in this section.
"Guest" means any person visiting a resident in any established preferential parking district, but shall not include any person attending events scheduled by any public or private educational institution including but not limited to classes, workshops, seminars and sporting events.
B. Designation of Preferential Parking Districts. The transportation and parking commission is empowered to establish preferential parking districts pursuant to this section.
In order to reduce the secondary impacts of the establishment of preferential parking districts, the transportation and parking commission may authorize the traffic and transportation administrator to expand the area of any established preferential parking district to encompass other adjacent streets surrounding a district. Residents who desire preferential parking in said expanded area must first meet the prerequisites for establishment of preferential parking districts as set forth in subsection C of this section no later than one year from the establishment of the original district.
C. Prerequisites for Establishment of Preferential Parking Districts.
1. In order to commence consideration of a preferential parking district, residents in the area shall provide a petition signed by residents living in at least seventy-five percent of adjacent dwelling units in the area proposed for designation. Petitions shall contain all of the following information:
a. Names, addresses and telephone numbers of each resident representing each dwelling unit;
b. The name and telephone number of a spokesperson who shall represent petitioners;
c. A statement that petitioners desire, agree and request preferential parking privileges, a shortage of reasonable, available and convenient parking for adjacent residents exists, and the currently posted time limits are causing a hardship to petitioners; and
d. The desired posted time limits or hours wherein a preferential parking permit would be required to be displayed.
2. After residents' petition has been submitted, the traffic and transportation administrator shall study the proposed area and determine whether reasonably convenient parking is unavailable and whether more than twenty-five percent of the vehicles parked in the area under consideration are not registered to persons who reside in adjacent dwelling units.
D. Findings. The transportation and parking commission shall establish a preferential parking district only if it finds that:
1. A shortage of reasonably available and convenient parking for residents of adjacent dwelling units exists;
2. Residents representing at least seventy-five percent of adjacent dwelling units desire, agree and request the establishment of a preferential parking district; and
3. Current posted time limits are causing a hardship to said residents.
E. Notification. Upon the transportation and parking commission's decision to grant or deny establishment of a preferential parking district, the traffic and transportation administrator shall send notices of such decision to all adjacent property owners or occupants by first class United States mail.
F. Appeals. Any resident aggrieved by the decision of the transportation and parking commission to grant or deny establishment of a preferential parking district may appeal said decision to the city council within the time and manner provided in Chapter 2.88 of this code.
G. Posting Required. After exhaustion of all administrative appeals, the traffic and transportation administrator shall designate established preferential parking districts by placing and maintaining appropriate signs indicating that the parking of vehicles which do not display a permit issued for such district is prohibited and the hours and days when such parking is prohibited.
During the hours and on the days designated on such signs, it is unlawful for the operator of any vehicle to park such vehicle on any street in a preferential parking district unless there is displayed on such vehicle a valid permit issued for such district or such vehicle is otherwise exempt.
H. Issuance of Permits. Any resident of a designated preferential parking district and owning or having control of a vehicle registered at an address in said district may apply for a preferential parking permit, to the city clerk. Residents not owning or having control of a vehicle registered at an address in said district may apply for guest parking permits. The applicant shall provide the following information: name, address, telephone number, vehicle registration, if any, and a utility bill or property tax bill evidencing residence within a preferential parking district. Upon approval of the application and payment of a preferential parking permit fee as set forth below, the city clerk shall issue a preferential parking permit and/or guest parking permits granting said resident preferential parking privileges for one calendar year (January 1st through December 31st).
Except as hereinafter provided, the city clerk may issue no more than two guest parking permits at any one time to any resident. Guest permits shall be valid for one calendar year (January 1st through December 31st).
I. Exemption of Certain Vehicles. No person shall, without a preferential parking permit, park or leave standing any vehicle or trailer in a preferential parking district in excess of the parking restrictions authorized pursuant to this title, except for repair, maintenance, refuse, utility, fuel or delivery vehicles doing business in the preferential parking district.
J. Permit Fee. Prior to issuance of a preferential or guest parking permit, the applicant shall pay an annual fee for each calendar year which fee shall cover the cost of administering the preferential parking program. Preferential parking permit fees shall be in amounts established by resolution of the city council, shall be reviewed at least once annually, and recommendations for any changes shall be made to the city council. The schedule for such fees shall remain on file in the offices of the city clerk and the traffic and transportation section.
K. Glendale Community College Parking Program. There is established a Glendale Community College Parking Program. Streets affected by the Glendale Community College Parking Program are designated on the Official Glendale Community College Parking Program Map which is on file in the offices of the city clerk and the traffic and transportation section.
Due to exceptional and unique circumstances that do not apply generally to any other property within the Glendale Community College Parking Program, the traffic and transportation administrator may issue a maximum of thirty-eight special preferential parking permits to the principal of Verdugo Woodlands Elementary School for the exclusive use of said school's faculty, employees and volunteers. Said special permits shall be used solely on North Verdugo Road between Oak Knoll Road and Kirkby Road.
L. Temporary Guest Parking Permits. The traffic and transportation administrator may, upon request of a resident possessing guest parking permits, approve and issue temporary guest parking permits whenever more than two guest parking permits are required for special events. Residents seeking temporary guest parking permits must contact the traffic and transportation administrator at least two business days prior to the special event.
The traffic and transportation administrator shall also have the sole discretion to issue special temporary guest parking permits to residents in need of health care providers. A resident requesting such permit shall submit a verified statement under penalty of perjury to the traffic and transportation administrator indicating the medical necessity of such temporary permit and the approximate period of time for which the permit would be needed. Other supporting materials may be requested to substantiate the need for said special temporary permits.
M. Termination of Preferential Parking Districts. The transportation and parking commission is empowered to terminate a preferential parking district upon finding that residents representing at least seventy-five percent of the adjacent dwelling units within a specified preferential parking district request termination of the preferential parking district. Residents may request termination of a preferential parking district by submitting a petition containing signatures of residents representing at least seventy-five percent of the adjacent dwelling units, the reason for requesting termination, the name, address and telephone number of each person representing each dwelling unit; and the name and telephone number of a spokesperson who shall represent petitioners.
N. Penalties and Revocation of Preferential Parking Permits. It is a violation of this section for any person to use any preferential or guest parking permit in any other district than the district for which the permit was issued. It is unlawful to sell, rent, lease, transfer or duplicate any preferential or guest parking permits. In addition to the remedies provided herein, any preferential or guest parking permit may be revoked by the traffic and transportation administrator upon a five-day written notice sent by United States first class mail, where it is determined that the permittee, guest or both, have violated any requirement established herein by this section. 10.36.040 Permit-Exemption from posted limits.
A vehicle with a preferential parking permit displayed in accordance with the instructions issued with the permit, shall not be subject to the time limits posted in the preferential parking district for which the permit was issued. The permit shall not exempt the vehicle from any other parking restrictions, regulations or laws. (Ord. 5086 º 2, 1995: prior code º 27-107.2)
10.36.050 Permit-Sale and use prohibited.
No person shall sell, buy or use any preferential parking permit except as provided in this chapter. (Prior code º 27-107.3)
10.36.060 Areas in which stopping or parking is prohibited-Established.
The transportation and parking commission is empowered to, and may, by resolution, determine that the stopping, standing or parking of any vehicle upon any street or part of a street is prohibited because of traffic congestion. The traffic and transportation administrator shall indicate such places by appropriate signs or curb markings. (Prior code º 27-108)
10.36.070 Obedience to signs or markings.
When signs or markings authorized pursuant to the provisions of Section 10.36.060 are in place, no person shall stop, stand or park any vehicle contrary to the directions or provisions of such signs or markings. (Prior code º 27-109)
10.36.080 Parking in business district between two a.m. and four a.m. limited.
No person shall park a vehicle on any street in a business district for a period of time longer than thirty minutes between the hours of two a.m. and four a.m. of any day. (Prior code º 27-110)
10.36.090 Parking of commercial vehicles in residential districts limited.
No person shall park any commercial vehicle more than five hours in any residential district except:
A. While loading or unloading property, and time, in addition to such five-hour period, is necessary to complete such work; or
B. When such vehicle is parked in connection with, and in aid of, the performance of a service to or on property in the block in which such vehicle is parked, and time, in addition to such five-hour period, is reasonably necessary to complete such service. (Prior code º 27-111)
10.36.100 Parking of commercial vehicles-Permit.
A. The parking of a commercial vehicle on any street in violation of the provisions of this chapter may be permitted by the chief of police when the vehicle is necessary in connection with work or services being performed on the premises adjacent thereto.
B. Application for a permit authorized by this section shall be made to the chief of police upon forms provided by the chief of police. The permit shall be issued by the chief of police upon payment to the chief of police of a permit fee of one dollar per day for each vehicle to be parked; provided, however, that a hood for a meter may be furnished upon a deposit of five dollars returnable upon surrender of the hood in operable condition, in lieu of a permit, by the chief of police at a cost of fifteen dollars per hood per year, payable in advance. No permit issued under the authority of this section shall be for a period of more than five calendar days nor shall the permit be issued more than one regular city business day prior to the first day covered by the permit. All fees collected shall be credited by the director of finance and administrative services to the parking fund. (Prior code º 27-112)
10.36.110 Parking in posted street.
It is unlawful to stop, stand or park any vehicle in any street between the hours of eight a.m. and twelve noon when such street is posted with signs at intervals of not more than one hundred fifty feet which give notice that parking is prohibited between such hours for street cleaning purposes. (Prior code º 27-112.1)
10.36.120 Removal of vehicles.
When streets are posted as provided in Section 10.36.110 and the signs also give notice that vehicles parked thereupon will be towed away, and such signs are erected or placed upon the street at least twenty-four hours prior to the removal, any regularly employed and salaried officer of the police division may remove or cause to be removed any vehicle parked or left standing upon such streets so posted. 10.36.130 Parking of boats and large vehicles limited.
A. No person shall park or let stand any boat or large vehicle, whether or not attached to a trailer or other device, on a public street or alley between two a.m. and six a.m. in a residential zone as established pursuant to Chapter 30.24, 30.28, 30.32, 30.36, 30.40 or 30.44 of this code, unless such person shall have a permit therefor, and in no event for a period exceeding two twenty-four-hour periods.
B. For the purposes of this section, a "large" vehicle is defined as any vehicle, together with all fixtures, accessories or property, with the exception of single-post radio antennas and side mirrors, which measures more than eight feet in width or eight feet in height or twenty feet in length. 10.36.140 Parking of large vehicles and boats-Permit.
A. A permit for the parking of large vehicles or boats during the time prohibited under Section 10.36.130 may be issued by the chief of police or the chief's representative upon application therefor. Each application shall be filed with the chief of police or the chief's representative upon a form to be furnished by the city and shall contain the following:
1. The name, residence and phone number of the applicant;
2. The license number, make, model and type of vehicle or craft for which the permit is requested;
3. The name and current address of the registered owner of said vehicle or craft;
4. The dates for which the permit is requested. Such dates shall consist of two twenty-four-hour periods, to commence in all cases at six p.m. and to end in all cases at six p.m. the following day;
5. The application shall be accompanied by a fee of two dollars, which fee shall be nonrefundable;
6. Such additional information as the chief of police or the chief's representative may require;
7. The application shall be signed by the applicant under penalty of perjury.
B. The chief of police or the chief's representative shall issue a permit hereunder if upon investigation the chief of police determines that the health, safety and general welfare of the neighborhood will not be adversely affected thereby. Such permit shall be displayed on the driver's side dashboard, windshield or instrument panel of the vehicle or boat for which it is issued.
C. In no event may a permit be issued under this chapter more than once a month for the parking of the same vehicle. (Prior code º 27-112.4)
