1.20.010 Penalties and punishment for code violations.
A. Except as provided in subsection B, C or D of this section, whenever in this code any act is prohibited or declared unlawful, or the doing of any act is required, or the failure to do any act is declared to be unlawful, it shall be a misdemeanor. Unless a specific penalty is provided, any person convicted of such misdemeanor shall be punished by a fine not to exceed five hundred dollars or imprisonment for a term not to exceed six months, or by both such fine and imprisonment.
B. With the exception of Title 10 of this code, any other provision of this code where the specific penalty of infraction is provided, shall be deemed an infraction, punishable as follows:
1. A fine not exceeding one hundred dollars for a first violation;
2. A fine not exceeding two hundred dollars for a second violation within one year;
3. A fine not exceeding five hundred dollars for each additional violation within one year.
C. A violation of any provision of Title 10, with the exception of Chapter 10.56, unless otherwise specifically provided, shall be deemed an infraction. An infraction under Title 10, except Chapter 10.56, is punishable by a fine which shall be established by resolution of the city council, either for a specific section under Title 10 or pursuant to a bail or fine schedule applicable to numerous sections thereunder. Any such bail or fine shall not exceed the sum of five hundred dollars for each violation.
D. A violation of the following Glendale Municipal Code sections shall be deemed an infraction punishable as provided in subsection B of this section, except that all violations after three convictions or nolo contendere pleas within one year, shall be misdemeanors punishable pursuant to Section 1.20.010(A): Sections 8.32.050, 15.08.080(D), 15.08.080(F), 15.08.080(H), 15.08.090, 30.24.180, 30.28.180, 30.32.130, 30.36.130, 30.40.130(a) and (b), 30.44.130(a) and (b), 30.48.130(a) and (b), 30.52.110(a) and (b), 30.56.110(a) and (b), 30.60.110(a) and (b), 30.64.080, 30.68.110, 30.72.100(a) and (b), 30.76.100, 30.80.070, 30.84.100(a) and (b), 30.88.110(a) and (b), 30.92.120(a) and (b). 1.20.020 Authority to issue citations for code violations.
Neighborhood services supervisors, neighborhood services inspectors and building inspectors who are certified by the commission on peace officer standards and training for "Penal Code Section 832 Modules 1 and 3, Powers of Arrest," shall have the authority to issue infraction citations for violation of the code sections listed in Section 1.20.010(D). Neighborhood services supervisors, neighborhood services inspectors and building inspectors are not peace officers and shall not be authorized to exercise the powers of arrest of a peace officer, or carry or use firearms within the scope and course of their employment.
